My husband and I divorced last year. There was not much equity in the house and he filed a quit claim deed during the divorce. We also had a second mortgage which has a current balance of $10,000 that is in his name primary and I secondary. He agreed to pay half of the monthly payments on the second mortgage. Now he wants to buy his own house and is trying to force me to sell the house, give him 1/2 the equity and pay off his half of the second mortgage. What rights does he have to any equity in the house that he quit claimed? Is he responsible for paying off his 1/2 of the second mortgage when and if I sell the house? My attorney is no longer a practicing attorney-HELP! I live in Illinois.
