I am from Oklahoma. I have been div. for 3 1/2 years, my ex still lives in the home that we purchased together. In our divorced papers it states that he is responsible for the home. Also he paid me some of the equity that was in the home at the time of our divorce. He does not have a very good record on making the payment on time. As a result he has ruined both of our credit. I want him to refinance the home because my name is still on it, I am also still on the deed. He has made the payment on time for the last 6 months. He refuses to refinance the home. What can I do to get my name off the mortgage?

My response:

Was it not a part of your Marriage Settlement Agreement that he was required to refinance the house within a certain amount of time ?

If not, then you couldn't possibly have been represented by counsel. This type of a situation usually occurs when a spouse does their own filing.

If it's not in the MSA, all you can do is sue him for "Partition", and all the money you'll be spending to sue him could have been avoided with a single paragraph in your MSA.
