My home is in Atlanta, GA. Other than find
another painter, how can I protect myself
from an injury liability claim from an
individual who does not carry liability insurance. Can I have him sign an affidavit
releasing me from any liability from any injury he may incur while working on my property. Thanks for your help!

My response:

Call your homeowner's insurance agent to comfirm, but most home insurance policies carry automatic Worker's Compensation Coverage for temporary employees, or employees who work less than a specified number of hours per month, like gardeners, maids (non live-in), painters, etc.
