What is the name of your state (only U.S. law)? MN

If I refinance and have my girlfriend, who lives with me listed on the new mortgage with me as a cosigner, can she use part of or preferably all of the interest deduction. She will not be a co-owner on the deed.

Read IRS Publication 936 - Home Mortgage Interest Deduction.

You have to own the home to take the deduction.

Your girlfriend will not be an owner so she cannot take the deduction.

In addition to the other response, your girlfriend would be a fool to agree to cosign on a mortgage when she would not be on the deed, and you would be a fool to put a girlfriend on your deed.

This whole idea is an extremely BAD one.
