My question is in regards to the topic posted below. I see that it has been years since that was revisited, so i want to make sure that it is still correct. I just started working for a security alarm company. Our standard contract is for 48 months. When i presented the alarm to a "top" attorney in my area, he said what i was doing is illegal. He said our monitoring contract cannot be binding for more than 2 years in california. He mentioned that it is for that same reason, that cellphone companies ONLY do contracts of 2years or less. On another note, we often do sameday or next day installs. He said its illegal to do so, and that we have to wait till their 3 day recision period is over to install the system. I just started working here and i want to make sure we are not doing anything illegal. i appreciate any input. thanks in advance!!! :)

3 years ago I entered into a 5 year contract with a home security alarm company in California. I have since then been told that they (the alarm company) cannot hold me to more than a 2 year contract for monitoring services in this state. I would like to cancel this contract if possible, and wanted to know if there was any truth to this.
My response:

I could not find any such limitation under the California Home Alarm Company Act, at Business & Professions Code section 7590, et seq.

What do your bosses say? You have no obigation to check out this stuff, your company likely has a legal firm on retainer. And no one here is going to spend time researching something for free for a potentially large company.

They say it is legal. why would they say anything different? they are getting paid for it.

I'm not checking on these matters out of ANY obligation. I want to make sure MY ASS is covered. I'm selling systems to ppl who i personally know and care about. I do not want to put them in a contract or sell them a service that is illegal to begin with. I dont want to ruin my reputation for a quick dollar.

And no one here is going to spend time researching something for free for a potentially large company.
The forum is called "free advice". I am asking for free advice. IF i worked for a "potentially large company" i would feel more secure about the contracts, but this is a new company that consists of about 8-12 employees. I dont want to make any further sales and help this company market themeselves untill i know if their practices are legal and ethical.
