Homeowner refuses to pay contractor

I am an asbestos abatement contractor that performed abatement services for an insurance claim on a property that was destroyed. The services I performed were only a small portion of all the work that was completed. The insurance company sent the homeowner a check for $66,000 to pay for the restoration of the property. Included in that $66K was an amount for the abatement work that I performed. The check has been cashed, but the homeowner's son-in-law is refusing to pay. I do not have a signed contract with the homeowner, however the work was performed and the amount the homeowner received included the abatement work. Do I have any course of action without a contract? I have a suspicion that a previous employee may have worked a deal with this individual and then destroyed all of the documentation...
