My wife and I were viewing a home with our Realtor during a schedlued visit in Roswell, GA. The home is built on a slab and the only additional storage is an attic space aobve the garage with a folding wooden stair.
When I reached the third step, the ladder broke (the wood was very dry) and I ended up with a deep scratch in my leg, about 1 foot long.
I did not seek medical attention and the leg healed fine. My wife and I said we would pay for the repair. The homeowner purchased a more expensive steel ladder, hired someone who would not produce a receipt to install the ladder and had the new ladder installed. They submitted a bill to us for $270.98 on 9/24/08. I found a similar ladder at a local store for $129.00. The bill for installation was supposedly $100, but the contractor or whoever it was, did not prepare a receipt.
We feel like the homeowner has full responsibility for his property and we should not have had to pay anything, but since we said we would pay for the repair, we sent him $100. The homeowner is now asking for the remaining $170.53. We feel that he has tried to take advantage of us and we do not want to pay any more.
If he were to take this to small claims court, does he have a leg to stand on?
