Last july I filed a claim with state farm for a leaky roof. They said get a couple estimates. I got 2 estimates, both of which said I needed a new roof. State farm said they want to send out one of there offiliate roofers. I didn't have a problem with that. He said the same thing, I needed a new roof. They sent out the adjuster, he said I did NOT need a roof. The only problem he saw was 3 broken shingles on the opposite end of the house. Needles to say he was not going to pay for the repairs regaurdless of the estimates I have gotten. Well 2 weeks ago The roof He said I didn't need is leaking down my front room wall!! I called State Farm again and they said they would send an adjuster out again. I have been with this insurance company for 13 years and never had a claim! What other actions can I take if thhey refuse repair again?

If I have a leaky roof I PAY to have it fixed, or if my roof is old and worn, I PAY for a new roof installed. I don't run out trying to make a claim against my HO... wtf! I save my HO for real claims, like fire, major theft and liability.

How can you sit there and say a damaged roof should not be claimable? I PAY thousands of dollars a year for insurance for a reason! Why else would I need it. BTW my roof is not old or worn. it is DAMAGED. If you choose to pay for something and never use it, then thats your business. You can keep your opinions to yourself. I did not ask for them.

If you now want to tell us that it was damaged by some event covered by insurance, that's fine, but don't scream because we didn't automatically guess at the facts you left out of your posts.

As seniorjudge said, you may have to sue to get any money from them. Don't rely on estimates to win the case, because all they prove is what a new roof would cost. Plan on gathering evidence why insurance should pay for the roof. Photos, descriptions of the event that caused the damage, relevant portions of your homeowners policy stating that the damage is covered, statement from the roofer that they believe that the damage was caused by the event you describe, etc.

The insurance company didn't deny the claim based upon it not being covered. That means that it WOULD be covered if they felt it actually needed replacing. msiron - you're off-base on this...OP has every right to claim this on their HO policy.

Now - OP - when you go to court, your strongest evidence will be your two roofers and the roofer that State Farm sent who all say you need a new roof. You will need to make sure they testify to this need...especially the State Farm guy

lol...ya. your real funny. Your right in one thing. you need to rest. Get off my thread moron if you don't have anything productive to say. And yes it was labled wind/hail damage in the estimates.

How old is your current roof? This is VERY important in determining if you are covered for the entire roof or just the couple of missing shingles.

And wow I can't beleive with your attitude I even bothered answering. (Guess I just love waiting those train wrecks:p ).

Guys, insurance does not cover brand new roofs. Insurance covers damage caused by a covered incident. Struck by lightning, tree falling on it, etc. A leaky roof does not mean coverage, simply because its leaky. This is not a warranty policy. AND, when the damage DOES occur, AND that particular damage is a covered event under the policy, it STILL doesn't mean that the whole roof will be repaired. The part that was damaged will be repaired. Roofs leak because of normal wear and tear, and they also leak because of a covered event. Nowhere in OPs posts (any of them) does he mention the REASON why the roof is leaking, which is the necessary element to see if it is covered.

OP: You don't pay insurance so that you can get a new roof when its leaky.

Examples:
Homeowners insurance provides coverage in the event of damage to your property, as well as liability for injuries and damage you cause to other people.
1. The structure of your house
This part of your policy pays to repair or rebuild your home if it is damaged or destroyed by fire, hurricane, hail, lightning or other disaster listed in your policy. It will not pay for damage caused by a flood, earthquake or routine wear and tear.

If your roof is not old or worn as you say, and it is leaking in one area... Why don't you let them fix the damaged area?

Go ahead and pursue them in court and watch them drop you fast afterward.

But, he said:

He never stated the CAUSE of the leaky roof.

OP: What caused the leaky roof? We can better answer you, once you answer that question.
