My state is Oregon.
This is a story that horrifies me and is unfortunately true and I want to know if I can sue for this.
1. In April of 2003, I was physically attacked by my stepfather.
2. When the police responded to the call he was arrested and charged.
3. I was contacted by a police officer and I further explained the matter.
4. I was subpoenad to the grand jury and it was found reasonable to charge him.
5. My step-fathers attorney apparently had a detective do a background check on me and this background check was turned into the DA's office who apparently told my mother and step-father that they could not drop the case but that they did not believe me due to the results of what the background check dug up. It is the background check and what it says that is the slanderous or libellous part of this.
6. The detective says in his report a copy of which I was never supplied, but my mother was and she is sending me a copy. Due to the fact that they had a restraining order on them for a year following the case I was not apprised of this information until just recently.
7. The detective said that as part of my background I had been fired from Wal-Mart because I was teaching witchcraft to younger people in the store. There are three problems with this statement 1. I do not practice withcraft. 2. I have never taught witchcraft to anyone and 3. I was never fired from Wal-Mart. I did work for Wal-Mart and I did transfer to a different store as I had moved and was caring for my father who was in ill health. I eventually resigned from Wal-Mart quite a while later as I found another job. In no way was I required to quit or in any way had a problem with my job or with anyone at it.
8. The Detective also stated that a person who he spoke to said that I was laughing about the situation and told them that I had only been pressing charges in order to get my mothers house. I would of course not gotten my mothers house her mortgage company would and she a couple months later acrtually did try to steal my mothers house. But I had never spoken to her about the subject at all.
9. He implied some deep dark evil secret of unspecified nature while I was in a monastery (Roman Catholic) in New Jersey. Well, I was in a monastery, and I am Roman Catholic, but there was nod deep dark secret, none. I had a regular life in the monastery and left because my father had poor health, as none of my brothers or sisters were in any position to help him with his health.
All of these things imply things about me that say to the DA's office I am untrustworthy and believe it or not has spread my name throughout Central Oregon as some kind of super wizard. The police department members of it have been known to go around town accusing me of being one and it has affected my family and business life as people there are really believing these things that are totally untrue and totally unfounded.
I am not paranoid and this is a serious matter to me. Central Oregon is known as the bible belt of Oregon and they take such accusations VERY seriously, I have seen other peoples lives ruined from their popular beliefs is some very wierd stuff. I do not believe but am eing victimized by their belief. Further, due to this I have been accused by members of the police force there who have spread my name around as being a Satan Worshipper, and saying that I have been seen flying over the desert and casting spells. People who have not even met me or know anything about the truth of the matter actually go up to my brother not knowing he is my brother and say that they have been taught things from me. My name is seriously being made into a cautionary tale for people like a fairy tale and I assure you it is not funny or pleasant. Further, these very accusations are now an official part of the trial process for my Step-Father's abuse and attack on me.
