I am making payments with my hospital and have not missed sending in a monthly payment, but it not always the entire pre-agreeded on of 30 a month, sometimes it is only 10 a month.They have always cashed the checks. Now the hospital has sent me a letter stating that unless I pay the total amount within in so many days, then the hospital will turn me over to a collection agency. Can they do this? My state is KY.

You have a payment plan with them to pay a certain dollar amount each money towards your account with them. Since you are not paying the amount they agreed to accept, you are (in essence)in default of your agreement. yes they do have a right to send it to colletions and also report it to the various credit bureaus. Are you able to pay the amount that you have under paid them? If you can pay that portion, perhaps they will continue to permit you to keep your payment plan.
