Hospital Malpractice? death of premie

Okay long story short I saw an old friend and she told me this and I wanted to know if she had a case cause I thought it was awful...
She was 5 1/2 months pregnant and started bleeding so she went to the hospital and they did an ultrasound and checked her out and said everything was fine...so they released her and sent her home. She was home for a little while and started having lower back pain and felt like she had to go to the bathroom and to me being a mom I know that is a sign of labor. She went in the bathroom and felt a lump down there what she described as a bubble...(which I though would be the babies head but I guess it was the sack or something I didn’t' really understand that part) Anyway, She went to the hospital and they have a major security thing where they won't let anyone into the hospital except through the emergency doors...so she went and knocked on the doors the nurse told her she had an ambulance and that my friend had to wait and she told her she thought she was in labor. After 10 min. she came back and let her in then made my friend wait in the waiting room for 1 hour all the time she kept telling them she thought she was in labor and they kept saying she had to wait her turn. So finally in the emergency room waiting about another hour and talking to her like she didn't know anything and like she wasn't having problems they took her to the delivery room when her water broke. Too late now to give medication to stop labor (Magnesium sulfate, brethine, terbutaline, etc.) she delivered a baby girl that took two breathes and then they came to her and said "Did you know what you were having?" and she said" I just found out a couple days ago it was a girl" and then they said she took two breathes and the eyes were still fused shut and its policy not to resuscitate. Not only that within like 10 minutes of finding out her baby died because the hospital didn't do there jobs the nurse came in and said "Do you know what funeral home do you want to call?" and didn't say it to nicely and she said I came in here in labor the last thing on my mind was a funeral home to call. So, in my opinion her baby died because they took there sweet time getting her there. I was so outraged by this. I told her I thought she should do something so I just needed some legal advice for her because I knew about this site. I feel so bad she lost her baby and I feel that it was the hospitals fault. I think they should have done more. Please help!What is the name of your state?

I don't know where you got that idea, but no, it's not over. Mary knows what to do. She's the one who banned me, and keeps banning me, because she has tender skin. She's being childish, and as long as she's being childish, I'll do the same. I'll just keep coming back under different forum names - - since, apparently, that's what she wants, and can't do anything about it, except banning each new forum name.

I have, thus far, refrained from contacting her at her home out of respect for her kids who use the computer, preferring to let her know my thoughts about her on these forums. Im sorry for your friend's loss and all the misunderstandings surrounding her loss.
She had bleeding went to the hospital, was checked by the least invasive means, an ultrasound, she was not in labor, she was sent home. At 22 weeks a baby is not viable and there was no labor to stop so she was released. Then what ever happened. From what you describe, apparently she had an incompetent cervix, the mosr frequent cause for 2nd and third trimester losses and it was too late to stop the labor and extend the pregnancy. She should consult her OB prior to her next attempt at conception so that there is an opportunity to avoid this problem in the future.
Right now she needs your support and understanding more than an attorney. Even if there was negligence, the outcome would have been the same. My niece lost her 1st child due to an incompetent cervix, but later successfully carried 4 to term.

I too am very sorry for your friends loss however, it does not sound like any fault of the hospital for your friends miscarriage. Unfortunately, like rmet has already said there was not anything that could have been done.

Your friend was likely hooked up to a machine, one of the components is called TOCO, it monitors contractions and the other component monitors fetal heart (although at 22 weeks it is difficult to monitor both and it is not very accurate this early either). If they did not see contractions on the monitor or feel them on physical exam, then she was not having contractions and a tocolytic such as mag would have been obsolete.

If your friend was 22 weeks there was nothing that could save the fetus (http://content.nejm.org/cgi/content/abstract/329/22/1597).

It is very unfortunate that the staff treated her so cruelly and didn’t offer more sympathy however, I’m sure it was a very difficult time and probably anything said would seem harsh. Dealing with the loss of a fetus is extremely difficult for the family but it is also difficult for the hospital staff too and often people do not know what to say and regrettably say things that just come out wrong and insensitive.

Thank you for the informative link which explains why the hospital's policy was to do nothing to revive the infant when it stopped breathing atfer 2 breaths, it simply was not viable and it was too late to stop the loss. Fetal death and deaths of infants are always so difficult for everyone.

Based on your description, the labor had progressed too far to stop and the fetus was not viable. There was nothing to do but deliver the fetus. As for waiting while another patient (in the ambulance) was received, that is called triage. Those who can benefit from emergency treatment are treated first; those who stand no chance, regardless of treatment, are treated last or not at all. The hospital has no duty to be sympathetic, just respectful.
Bottom line, no case.
