What is the name of your state (only U.S. law)? FL

I am an administrative support person. My pay grade is as an hourly employee. I work alongside another admin support professional who is Salaried. When this person is absent I support their manager. Should I be paid a differential because I am performing responsibilities of a salaried employee?

It is ALWAYS legal to treat someone as non-exempt, even if their duties might qualify as exempt.

There is practically no benefit to the EMPLOYEE to be treated as exempt. You are better off as non-exempt - you are paid for the time you work, and if you work more then 40 hours in a work week, you get overtime.

Not to mention that there is never a requirement that you be paid additional compensation for additional duties. As far as the law is concerned, if you are non-exempt and are paid minimum wage plus time and a half for any hours over 40 in a week, or if you are exempt and are paid $455 per week, you are being paid properly.
