How can employer cancel H1B visa

We recently agreed to sponsor a french citizen for a H1B visa. We sent the paperwork and a check for $2435 to USCIS. The case is currently pending but we have come to find out that the individual misrepresented his qualifications and has also become borderline hostile once the application was filed.

my question is: 1: can I cancel the visa application and 2: if so, can I recover all or some of the application fee.

I doubt if you will get the money back what you can do is inform the USCIS that you wish to cancel the H1B application and ask them at the same time if you can get a refund.

You can withdraw the pending H-1B application but the fees are not refundable.
