It's possible he doesn't even own 50 %. If dad's share went to mom, she had 2/3 to dispose of as she saw fit.
It sounds however as though he knows its 50%...but if it wasn't, it should have been 1/3 plus 1/6th of mom's share (6 total siblings inherited intestate) which would give him 5/12ths total which is darned close to 50%.

There's not currently any "intestate" inheritance. The property was deeded away while the mother was still alive. It's quite possible that he owns 1/3, and the other siblings each own 2/15.
