How do I get HOA to enforce the covenants?

What is the name of your state (only U.S. law)? Florida
How do I go about getting the HOA to enforce the covenant of our block?

Our block has several covenants that are governed by the HOA. No one on the block is a member of the HOA except for the homeowners who actually have waterfront homes.

The next door neighbor has put up a privacy fence all the way to the property marker at the front of the property. The covenants state the fence is not to be any further forward than the front of the main dwelling. The fence is in front of the neighbor's garage door on the other side.

Any suggestions would be helpful.

If you are members of the HOA you can band together with other members to change their behavior. Other than that you're out of luck. If the people you are griping about aren't subject to the HOA, it's going to be hard for the HOA to put any pressure on them to comply (it's not clear from your description who is in the HOA and who isn't).

Everyone on the block who is in section A is not a part of the HOA. Everyone who is in section B (homeowners actually with lakefront property) is required to be a member of the HOA.

So I am out of luck to get the spite fence removed by the neighbor since neither of us is a member of the HOA.

Your local city/county zoning ordinances may have fence height regulations for side yards in front of the home. Check with them.

It would seem that you have no authority to have the force the HOA to do anything, nor is the HOA going to have much leverage other than taking the non-member property to court.

You can sue your neighbor yourself if you like.

HOA wants to have this handled quietly.

Several Real Estate brokers have contacted homeowner's insurance firm for additional guidance.

This problem is now affecting several home sales in the general area.
