I was in a 2 year relationship in which I loaned my ex about $4000 for a car. He also talked me into using my credit card to purcase items for his kids. The grand total comes to more than $5000. Now that we are no longer dating he has told me that he will not pay me back for anything. I have some receipts for things but I am not sure if I have a case?? Any suggestions?

My response:

Unless you have a separate writing / agreement from him to pay you back, you're out of luck. Judges don't involve themselves in matters of love, and intents while in love, and then when feelings change, all of a sudden wanting their money back. If courts did this, the system would be clogged to the point of crashing.

Since you'll have the "burden of proof," prove it to me. Prove to me that a verbal/oral agreement existed - - as opposed to these monies being "gifts" to him.

And then, once you've proven an oral contract to me, prove to me that your contract doesn't violate your States' "Statute of Frauds" or, that since so much time has passed, that he won't be able to use "laches" as his defense.

You see, you have no idea what I'm talking about, do you. I can hear it now; right about now, you're saying "huh" ? I can also see that big, mournful, tearful, look on your face of complete confusion.

This is what happens when you don't put your "understandings" in written form, and had him sign it.

Just because I am a woman does not mean I am weak. It also does not mean that I would break down and cry.

Perhaps you should not assume that women are weak and incapable of making decisions or using good judgment. It also does not mean I am stupid. I would not assume anything about you based on your reply, although I could.

My response:

I'm so sorry that you didn't like my reply. It wasn't meant to be liked, however. It was meant to show you your "reality" in the law, and the way a judge would have looked at you at the Plaintiff podium. So, you're very lucky I saved you the public embarrassment in a courtroom.

All because you're feeling bad that you've lost over $5,000.00, don't take it out on me. In this instance, I didn't have to "assume" that you failed to use "good judgment" - - your original post told me that you hadn't. You failed to protect yourself from being used.

So, if you can't appreciate the fact that I gave you a "heads up" into what a judge would say to you, and how a judge might look at you, well then you're better off in a dreamworld, and I'd understand that "reality" is not your bag.

If you want to be pissed off at me, well, you go right ahead.
