My divorce decree states that my ex must refinance the mortgage 90 days after the divorce is final. This was a few years ago, and he hasn't done it. My attorney didn't work for me in that she didn't answer my faxes, phone calls or letters so I just went ahead with the divorce without her. Is there recourse on my part to get my name off the mortgage and credit cards (the decree states that I am not liable)? It is messing up my credit because he never pays his bills on time and I am not able to get any kind of loan in my name especially a mortgage because it appears as though I already have a mortgage. I hope I was brief and gave you enough information. My divorce was finalized in Illinois.
Thank you. Kathy

My response:

You have to sue your ex-husband for "Breach of Contract", "Partition of Real Property" and "Specific Performance" (something he probably never did while you were married, anyway).
