i work in a tavern/restaraunt at a resort I have two issues going on here,
my manager has a hand problem, I've told him already twice not to touch me. he has a thing for rubbing you on the back, he smacked me in the head once and this past weekend he flicked me on the hand. ok, i know it's not a sexual but i don't want this man touching me. and i've told him so. i've informed the assistant manger this past saturday .

I find out on Sunday by a customer (#1) that he thought i ripped him off for $5.00 I was shocked needless to say....i was wondering where this customer #1 had been, it comes to light that he told another regular (#2) that he thought he was shorted money by me the night he came in, well this other guy(#2) said to #1 ; that he saw me do it, she took 5 dollars off the bar and put it in her tip jar, that i was also charging #2 for regular beer and putting it in the register as happy hour. (happy hour beer is a $1 cheaper)and putting the differance in my tip jar --- #2 goes and tells the hand problem manager that I stole money from customers and was ripping off the register.

#2 goes back to #1 and tells him that i was reprimanded and never allowed to bartend work the register again.

i was not informed of anything until #1 came over and shook my hand forgiving me of my transgression.....
I am soo angry, upset that I was not told that someone accused me of stealing money from the bar, of stealing period! and the assistant managers wife let it slip that i have been under surveillence for the last 5 weeks.....

I have no idea what recorse i have, not even sure i want to go to work, but the bills keep coming so i really have no choice at the time.

people any advise would be helpful, contact a lawyer?

It would be easier to tell you what, if any, recourse you have if I could understand your post. Can you please edit it somewhat? I'm sorry, I'd like to help, but I just can't follow it.

Give us a timeline and ask three questions.

I cannot tell what you are talking about.

As far as I can tell, your employer has given you a reprimand. That's it. Why would you contact a lawyer?

Katey,

that's just it, I didn't know about any of this, I wasn't reprimanded, I was not aware anything was wrong until the customer came and told me himself. I go to work on Friday and I have no clue as to what to say to my manager.

the other problem is being accused of stealing by a customer and not being told about it, from management

then being told i've been watched for the last 5 weeks.

I am NOT an employment lawyer, so maybe some of them will get on here and tell you what to do.

BUT this sure looks like retaliation to me!

But all retaliation is not illegal. By the OP's own admission, this is not sexual; therefore I'm by no means convinced that it would be a protected report.

If it's not protected, then "retaliating" because of it is not illegal. Nor does it sound (though I could be mistaken because the post is so garbled) that the "hand manager" as she puts it, initiated this action.

sorry for being so garbled. the touching thing I just want to stop. i've told him twice, told the assistant manager once to please tell him to stop touching me, hitting me, if i could i'd switch shifts not to work with him

i'm a wreck over this, the hitting, the being watched, being accused and not being told

i can not quit, but i am looking for other employment.

You've reported the touching to your manager. That's all you can do at this point. I don't blame you for not liking it but some people are just like that. It's not sexual; it's not harassment; it's not illegal.

As to the other, it really doesn't sound as if any laws have been broken. If a customer complains, they are free to take what action they feel is appropriate, even if the customer is wrong.

My bad! I don't know how but I skipped the hand part.

At the bottom of this post is an EEOC site talking about sexual harrassment. It's doubtful that what you are describing would actually be considered sexual harrassment - (however all this touching, while it hasn't gotten too out of hand (BAD PUN) - you can bet it's sexual.) Either way, it's unacceptable and it is beginning to create a work environment where you are thinking about quitting due to Mr. Hands.

Is there an owner to go to?

You could print out a flyer on sexual harrassment and give it to the manager. What do you think?

Write a letter, i.e.:

Dear Mr. Hands,

I am writing this letter to document that I have requested that you not put your hands on me at work. This makes me very uncomfortable. I love my job and don't want to have to quit due to this problem.

Katy, I beg to differ. I know a number of people both male and female, who are "touchy" people and there's nothing sexual about it. Some people are born touchers - they need physical contact. To a certain extent I'm one myself. Not all instances of touching in the workplace are sexually based.

Quite apart from that, I also do NOT recommend writing a letter such as you describe. It's been reported to the manager - give the manager a chance to handle it before taking further steps.
