I bid on a doll on ebay and won. I didn't pay for it because the seller refused to cooperate and was rude from the beginning. the seller, located in California, posted feedback for me that contain lies. She states (this is copied and pasted from the actual ebay public profile)

First off I never did what she said in the first comment. this is all lies.
Also, she posted on SquareTrade I was malicious. This too is a lie.

Ebay refused to do ANYTHING. They said I need a "legal document" to get
the feedback removed.

Please, tell me how to get a legal document to get the libel taken off my record at Ebay.

P.S. to above post ....

I have spent over 8 years building up my feedback to have one person ruin my almost perfect record. I cannot really delete my account and "start over" as others have mentioned on other ebay-related libel. Beside what they said about me is NOT just an opinion, if you read the actual statement they made. :rolleyes:

Fuhgetaboutit and move on. It's not worth getting your panties all twisted up. Folks put way to much emphasis on feedback for no reason. You can't make everyone happy and worrying about it will get you nowhere.

I have a similar problem. Only here is what happened. I sold a Brand New purse. I listed it under "with tags". It still had plastic on the shoulder strap and the paper that was inside it. It was a Dooney and Burke (sp). The auction closed Nov. 9th. I sent it out around the 15th. On Dec. 23rd the buyer started accusing me that it was not brand new. That it had no tags and that something had spilled on it. I asked why they waited over a month and a half to tell me. They just said they never looked at it until then. Then they left negative feedback. I replied to the negative feedback (under my name not on their feedback) that they waited 2 months to tell me, wanted money back and were a liar and a cheat.
I said that because it was almost 2 months later. It seemed they were trying to get their money back right before Christmas. That they were lying (there was nothing on it when I sent it). And I think it is cheating to leave bad feedback 2 months later (after I already gave them good feedback) just to be spiteful.
I also replied to the good feedback I left that they are liars and I was blocking them from future purchases.
Now they are threatening to sue me. If I live and sell in Kansas, isn't this where they will have to file a law suit?
Don't they have to prove the purse was spilled on? that it did not have tags and was not brand new. Because I have witnesses that it was brand new.

By the way, after he threatened me, I said "please do not email me any more. If you would like to settle this through Square Trade, I would be glad to consider a resolution". He just wrote back, see you in court.

I would think the burden of proof would be on him in this case. Who knows where he thinks he will be suing you. My advice to you is to document, document, document. If you offer square trade resolution and he refused, surely there is some record of it right? Print out and keep all communication between you. He may just be bellowing and have no intention of following through but if he does, better to be prepared.

I have copies of all our correspondences. I even have pictures of the purse right before I mailed it out. Brand new with no stains. Pictures were taken with my Canon Rebel so if I bring them in you can zoom in and see the perfect condition of the leather. I just don't really want to deal with a lawsuit -- especially if he files in the wrong state. I hope if he does that I can counter sue for court fees and travel fees. Because I will stand up for myself. Like I said the negative feedback he is saying he is suing me about, is under my user name. How is that costing him money?
DEFINITION: Libel is the publication of a false statement, (and is not a privileged communication) which injures one's business or personal reputation.

A plaintiff who sues for Libel must prove all of the above and be able to demonstrate some type of resulting damage. This could include being shunned by friends and associates, inability to obtain work because potential employers believed the false accusations. Some states allow for a jury to assess damages based generally on reputational harm.

(I just don't see him proving this -- if anything I have lost business because of his negative feedback).
