What is the name of your state? OHIO

My boyfriend and I bought a house in Sept. 2005. He is the main borrower, and I am a cosigner. Both of our names are on the deed. We are breaking up, and I want him to have the house. We got a first time home buyer loan that stipulates we cannot sell the house for 5 years or refinance for 5 years. How do I take my name off of the deed, and mortgage legally? Also I have a vehicle lease in may name with him as the cosigner, but the vehicle is titled in his name. How do I put the lease in his name and take mine off?

A: Pay off the loan and sign a deed to your boyfriend.

You can take your name of the deed pretty easily.... just sign a 'quit claim' title transfer. However, you would be an idiot to remove ownership without removing the obligation (mortgage). And the ONLY ways to remove your obligation on the mortgage are:
1) To sell the property and pay off the mortgage, or
2) To refinance the property and pay off the mortgage, or
3) Get the WRITTEN permission waiving your obligation from ALL parties to the mortgage agreement.

Pretty much the same options as above.
