How do I write an Agreed Entry?

What is the name of your state? Ohio
My ex husband has agreed to ALL the terms of my impending out of state move(visitation and child support). I have spoken with the courts and I was told we can avoid court all together if I can compose an Agreed Entry and get it filed. I need help writing this up so that it is worded correctly(from a legal standpoint). Anyone? Thanks!!!! :)

Hire an attorney to write one out. If you don't you are going to have problems. Also what about child support have you decided upon? And visitation? There are so many loopholes and drawbacks to people writing their own agreed entries if they have no legal training that you really should hire an attorney for a couple hundred dollars to write it for you.

Thanks for your reply. As far as child support goes, it will be lowered to $75 per week and, also, $1500 in arrearages will be taken off. (At least that is what we are proposing) As for visitation, It will be 28 consecutive days in the summer, Spring break in odd years, and we will split christmas break, alternating the 1st and 2nd halves. There will also be other visits during the year such as when I come to visit family & friends.
Hiring a lawyer is not really an option. I just don't have the funds right now. When I spoke to the courts this morning, I was told that there is someone there who can help me with some of the Agreed Entry, but I am not sure where to start. Do I just compose it like a letter? Thanks again. :cool:

It is not a letter. It is a motion that both of you must sign and, preferably, have notarized and submit it to the court asking them to agree upon it. You need to be specific as to why child support is being lowered and arrearages are being forgiven. Also make sure you include transportation issues, dates and not just first half and second half of breaks (Christmas break from 5pm the day school lets out until 6pm on December 27th for example), telephone access, and what 28 days will be in summer. You will also be required to fill out and complete a financial affidavit (each of you) and a parenting affidavit because these are required by the Ohio courts with ANY motions for changes in child support and custody. I dont care if you dont have the money you really need to talk to someone for an hour.

Thank you for your input. As for having the dates of visitations, I DO have those listed in the agreement, along with the transportation issue and health care. I was just trying to keep it short and to the point on here. The reason for child support being lowered is because it will be adjusted anyways when it is reviewed because he has changed jobs since the first CS order in 2004. The amount I stated for CS is aprox. what I got from the CS worksheet.
I have already completed the financial affidavit and parenting affidavit.

While you want to try to keep it short, you MUST be detailed and specific. Make sure you agreement contains nothing vague and broad or else you're going to wind up in Court fighting it out. There is nothing wrong with a 15/20 page parenting plan. As long as it's all spelled out clearly, that is what's important. Even if you guys might be getting along NOW, you have to think long-term.

You REALLY need to consult with some attorneys to see what they would charge just to review and do the paperwork for you. An attorney might also tell you what you're missing and addressing any possible questionable language.

Thanks for your response. I just finished the Agreed entry and I am meeting with someone from the court who is going to go over it for me and let me know if anything needs to be changed or reworded. If I still can't get it right, I will contact a lawyer to go over it for me. I have covered everything that will change in regard to visitation(including dates), transportation costs, child support(why it is being lowered and arrearages reduced) and health insurance(who will provide it and pay for co-pays and such). I am just goning to go from there. Thanks again!!!! :D

No, not an attorney. She is the person that aproves all of the filings before they go to the judge. She said she will go over my papers and help me correct them, if needed.

Wow. In AZ and in CO, that's illegal as all hell. :eek:

She is in the compliance office. I just got back from talking to her and she is going to review my paperwork and call me. I assume it's not illegal in Ohio, since she is doing it. :)

I don't know. Ohiogal would know! She's an attorney in OH. I was just making a comment; should've kept my unrelated-state thoughts to myself. :)
