How do we divorce w/o a lawyer?

My wife left me in July. After she left she got involved with someone from her work. She is now pregnant with his child and her and I have a 3 year old daughter together. We have been married for 4 1/2 years. In the interest of our child, we are on very good terms despite her infidelity. We have agreed to raise her together while maintaining a workable, respectful friendship. We have agreed on all the terms of the divorce; who gets the debt, the house, furniture, shared custody, etc.,. My question is: do we really need a lawyer if we agree on all basis? The only reason I'm trying to get out of using a lawyer is finances. It would take me almost a year to save up enough for the retainer fee. If i do need a lawyer, what's the best way to find one without incurring huge fees (if that's possible)? If i can go through with the divorce without a lawyer, what's the next step I need to do to accomplish this?
(By the way, we live in Nebraska)

My response:

Most of the major, and larger, bookstores have a legal section, and the necessary books with forms you'll need. Also, you might go to a law library at a college or law school, and ask the librarian to help you get the books you'll need to read.

Then, after you're done reading, you'll be able to take the Nebraska State Bar Exam and become an attorney.

In other words, you've got a lot of reading and work ahead of you, if you intend to do this without an attorney.

Thanks for your input.I appreciate your time. Here's my next question: since I most likely need a lawyer, are there any state funded options for those with financial hardship? I guess my thought is, if the court will appoint a state attorney for criminals that cant afford one on their own, do they do the same for those seeking divorce? Also, if there are any attorneys in my area that work pro bono, how can I get in touch with them? Once again, we live in NE.

HomeGuru response: Check with Legal Aid, the local chapter of the ABA and the ATLA. The American Bar and the Association for Trial Lawyers of America many times offer pro bono services.

My response:

First of all, divorce is a Civil matter, not criminal (although, some people feel as though what's happening to them is "criminal"). Having an attorney assigned to you in criminal matters is Constitutional in nature. Attorneys are never "assigned" to litigants in Civil matters.

So, if you don't want to look into getting some books on the subject, then your next best hope is to call the State Bar and ask if they have a "Pro Bono" panel of Family Law attorneys. If they do, get a referral or two, and then consult with them before you make a choice. Just remember, you get what you pay for - - so, if you don't pay, you'll get what you pay for.

If this doesn't work, go back to "plan "A" - - the books.
