My husband is in the process of filing for sole custody but we know that it will take quite a while to get resolved in the courts. The judge sent my husband and his ex to mediation to try to work out a new parenting plan and could not come to an agreement (about 7 months ago). We have a parenting plan drafted up but we don't know how to file it with the courts to request it to be put into an order. Something needs to be done beacuse the current order is VERY vauge. The reason it is like that is because the judge ordered them to medication but there was no result from that.

You need to submit it as part of a modification. But I'm confused. If they've already been sent to mediation, then why are you trying to submit new paperwork? Usually if mediation doesn't work, a trial date is set.

Maybe a new perscription? ;)

Yeah we don't know why we didn't get a court date either, that is what we have been waiting for but it has been months now and there hasn't been any hearings set. I hate to pester more but I have been looking at the maricopa.gov website under the self help part and I cannot find what paperwork we need to file the new plan. We know mom won't agree to it but that is ok because we feel that it is more than fair according to the state guidelines for long distance parenting and if it goes to court he will get a ruling in his favor. we just need to kno what steps to take to get the ball roling to get the parenting plan considered.

It would be titled something like "Motion to Modify Child Custody and Visitation" or something to that effect. Try looking for something with similar wording on the Maricopa website.

Ok I found something like that.

This is what I found.... Petition to Modify Parenting Time (_Visitation") or Parenting Time and Child Support
