How does my husband go about adopting my son?

What is the name of your state (only U.S. law)? Wyoming

My ex-husband was arrested over a year ago on his sixth DUI conviction and has spent the last year in jail. He recently had a hearing that is keeping him in jail for at least another year. All of this time he has not payed child support nor has he contacted our son in any way. By the way, the ex lives in Georgia and my son and I live in Wyoming with my new husband.

My son is fourteen and no longer wants to have anything to do with his father. My new husband wants to adopt him as his own and my son desperately wants that too. What can we do to make this happen? Any advice would be greatly appreciated!

Is Dad willing to sign over his rights?

Thanks for responding, Dogmatique. Like I said, dad is in jail and his sister won't tell me what jail it is. I'm sure he'd sign over his rights to avoid having to pay child support arrears. He's also told me, in the past, that he wants nothing more to do with his son. He even said that to our son, which incidentally, tore the child apart.

If I can find him, what paperwork do I need to send him to sign to terminate his rights to our son? And, if he signs, what steps do I take then? Thanks in advance for any advice!

Jetx, thank you so much for the link! I will be perusing it shortly. As far as an attorney goes, I try to avoid them as I have handled many court cases in the past pro se and have had good outcomes. I just need to know how to proceed. Thanks! The seniors here are very helpful and I most appreciate that help.

You could try the Department of Corrections to see where/if he's a guest of the feds...

Ok, I found dad today after a month of searching. He's in jail just as his sister told me and I have the address to write to inmates there. My question is: can I just write to him asking his permission for my new husband to adopt our son or is there some sort of legal form I need to send him? Thanks for any help!
