how goes a step-dad adopt with out bio-dads permission

i live in arizona and have sole physical custody of my 3 1/2 yr old son since my divorce i have remarried and have had a child with my new husband. my som has been rasied by my hubby since he was about 1 1/2. in the beginning most visits w/bio dad took place only if we took him to him and picked him up. since christmas eve 2000 he had seen his bio- dad on three occasions, for only a few hours on two seperate days about 2 mths apart and those visits were accually arranged by his family, once by his mom and once by his sister, he just happened to show up at there requests of him to come see his son. the third time was last sept and he stayed 2 nights then he brought him home. he missed his 3rd b-day christmas, and he never even showed up at the hospital for our childs surgery in april. he keeps no phone contact either,he knows my hubby as daddy. recently i foundout my ex moved with out informing me or the courts, in the papers it sates he has to .he told me who he was staying with but not an address, and told me the court didn't need to know.he pays cs only because i had to get it court ordered and garnished from his check, he is only one payment behind (but says he isn't responsibly fo it, his work is.), his company said it was because he didn't work for afew weeks, thus no money to garnish. he called yesterday and wanted son for the night, i said we had plans but on his regular visitation day he could. he said he would never sign his rights over and that he was going to the courts to get visitation days changed . what can we do, how do we go about having my hubby adopt him with out bio-dads permission.just a note i do have extensive records of every visit, and no show.sorry this was so long but i'm [email protected]

I suspect the answer is "you can't". Unless bio-dad is willing to give up his parental rights and consent to the adoption, no adoption can take place.

You child is fortunate to have such a great step-Dad. Unfortunately for you, he also has a bio-Dad who wants to be involved (if only a little). In the long run that's best for your child, so I'd advise against trying to interfere with that. A child has a right to a relationship with his bio parents - unless such a relationship endangers his safety.
