What is the name of your state (only U.S. law)? California
I am embarrassed to admit that I signed up for a warranty with Automotive Professional Resources. They will not respond to me via phone or email. As stated in the contract, I have sent a formal letter to the seller (as well as my credit card co., the administrator of the warranty, and the lienholder) requesting cancellation of the warranty. The warranty was for a five year extended warranty.
My questions are:
1. Are they legally required to respond to me within a certain period of time? Although the contract clearly says I have the right to cancel, I cannot seem to find a specific statement on this anywhere in the contract or online. I am wanting a physical document of some kind from them stating that the warranty is cancelled, yet I cannot find any legal reference to such a requirement.
2. Do I have the right to contact my credit card and stop payment on any future withdrawals from this company now that I have informed them of the cancellation?
3. Do I have the right to expect my deposit back (particularly since I agreed to do this over the phone and have not signed anything)?
Any help would be greatly appreciated. Also -- if you know the specific legal references/language to answer these questions that would be wonderful as I feel I may be needing them.
