My boyfriend is the NCP according to his divorce decree and is ordered to pay child support.

Since August his two boys have been living with him because his ex, the CP, asked him to keep them until she "got on her feet". She refuses to sign any temporary agreement. His lawyer recommended he file for custody on his own to save money after the boys have been living with him for awhile.

Again he asked her to sign a temporary custody agreement and she refuses. My boyfriend is afraid if he files for custody she will become angry and take them back from him and put them into a bad living situation. What step should he take right now?

Well, that might be a wise question to ask the attorney to start with.

Dad could file for custody and request that he be granted temp custody since the boys have been living with him.
