Our written lease expired Sept. 30th, When I went to pay the rent for September, I asked about a new lease. I was told that we could go month to month or sign a new lease for a term of one year. At the time I did not think that we would be in the position to purchase our own home and told them we would like a one year lease. They said they would have a new lease ready when I came in to pay Octobers Rent. They have never givin us a new lease to sign.
We have decided to purchase our own home and tried to contact them via telephone. Have left several messages and they finally called us back. They said that they require 60 days notice and to give them a letter of our intentions when we pay January's rent, which we did. We gave them 30 days notice and intend to move out before then, but paid for the whole month.
My questions are:
1. How many days are required by law for notice to be given?
2. Since we did not sign a new lease, are we still responsbile for a 1 yr since this was verbally expressed? It states in our expired lease that the lease can be extended only by written agreement signed by both landlord and tenant and a new lease is required for each year.
3. In the letter, I asked to schedule a walk thru with them on the day that we turn in our keys and garage door openers, they will not do this. I have heard from other people renting from them, that they are very hard to get any deposit back from. We have $2,050 security deposit and $600 pet deposit. How long do they have to refund our deposit?
4. The house was brand new when we moved in. We just had the carpets professionaly cleaned last week. What is considered normal wear? Do we need to paint before we move? It's mainly touch up of hand prints and such from the kids and the house has no damage. We intend on hiring someone to come in and clean after we leave.
I guess my main concerns is questions 1 & 2. Thanks for the help.

It all depends on what your lease states... most states require a minimum of 30-days notice, but if your lease states 60-days, then it is 60-days...

As for the deposit, write them a CRRR letter stating they have 21-days to return your deposit, and if there are any damages they want to claim, they need to itemize it and the amount of the dedcution. I hope you took lots of pictures!!!

dont forget to take pictures that are dated by the film processor as soon as the unit is clean and also you might as well take some pics once its empty but before the cleaning service comes .

I have re-read the expired lease again and it does not give a time frame. The only verbage is what I stated before, the extension is by written agreement only. So am I safe to assume that 30 days notice is sufficient, even if they are now telling us it's 60.
When we moved in, I took pictures and submitted a list of things that needed to be fixed, most were warranty issues and they brought the builder in to fix, but there are some minor things that they did not bother with. I still have those pictures and a copy of the list.
I will take pictures once all the furnishings are removed. Thanks for the advice.
One other question, Are pet deposits refundable? The lease just says a pet deposit in the amount of $600.00 is required when signing the lease. Someone told me that usually pet deposits are non-refundable, but shouldn't that be stated?

Looks like under Florida law you must give them a 60-day notice. A tenancy of nonspecific duration may be either written or oral. Either you or your landlord can terminate such an arrangement upon the following notices: For a year to year lease it is 60-days
