I work for a 501c. We used to have 2 bookstores with full time managers. We lost the space for one store and when we reopened a second store we had a "new model". A full time business manager supervising 2 part time "asst managers" (one at each store). We opened a third store with a part time "manager". The business manager spends eight to ten hours at first store, one hour per week at the second store and one hour per month at third store. Business manager does the sales reports for 2 stores but not the third. Business manager does hire or fire at third store.
Would this arrangement be considered a sham designed to deny benefits to part time "asst managers" and the part time manager? thanks
