How much money should my landord pay me to buy out our lease?

I will post this question again due to irritating member reply.
I have moved out of the home i rented for almost 3 years at my landlords request. she is selling. I have this in writing. i will not be sued for lost rent. she asked my husband and myself what price we wanted to be bought out for? We assume if we were to have broken the lease we would have had to pay rent up until the end of the lease or when they found a new tenant. What should the case be for a landlord who breaks a lease. Granted we have already moved out, but have not had a walkout or returned keys etc. So she i supposed could screw us. She is a realtor, not that that makes her a saint, but i trust her word. She is a professional. She just wants to know how much we want to be bought out for and we have no idea. Should it be our monthly rent times the number of months we left early. Or should it simply be a flat amount. Say 1000 dollars? your help would be much appreciated. Thank You.

There is no such thing as a fair amount . let your conscious be your guide . Now that you have moved she can refuse a amount if its too high . there is no such formula that I have heard of .

And i will answer again the landlord owes you NOTHING. YOU owe the landlord for the rest of the lease or until it is sold or re rented.

All you are entitled to is your security deposit back. So thats it........

Anything over your security deposit, is up to you, the landlord can LEGALY say no.

ONLY in New York City or in parts of CA if you have a rent controlled lease, can you force the landlord to pay you $50,000 $100,000 or even more to move.

We had a case here last year where on Madison ave. some 50 years ago a very rich person had a big town house and in the back yard bult 6 small cottages for guests well over the years it was rented out, Then some big conglomerate bought the property next door and wanted to expand, and tear down the houses, so the tenants fought since thay had a courtyard of trees and grass in Manhattan...how rare is that....!!!!!

well they got ...you ready for this..$1,150,000 each to move!!!!


So the moral of the story is YOU have NOTHING in writing and you are teachers who are trying to SCREW a landlord.

YES a lease works both ways and if a landlord wanted to break a lease then the landlord must pay you to move......BUT YOU ALREADY MOVED OUT!!!

You really should be embarsassed over this...what 6 years of college and you dont even understand a simple rental lease, no wonder our kids are failing in school!

i understand the lease just fine thanks. its the buying out amount that i dont. we have not fully moved out yet. we paid May rent and have not done the walk thru. We still have the keys and garage with our things in it. The place is still ours in case you were still stuck on that... bloomy. And we are trying to cover OUR butts which is why i posted on this forum, thinking we could get some constuctive help help here. Instead we get some loser who has nothing better to do with itself than put strangers down. Now whos the educated one?
We are doing the walk thru today. So i take it your saying we can hold out since we technically have not "moved out". We simply hold onto the keys keep the rest of our things in the garage until she comes up with an amount we feel comfy with. We will see tonight then. Thanks for your help.

Well that what is lease is.......

YOU owe the rent each month until october, the landlord CANNOT refuse to take your rent for JUNE, so you have a legal right to live there until then.

Now if the landlord wishes you to move then they have to pay you...thats clear.

But if you DONT come to some agreement, YOU MUST pay June's rent on time, if you dont then you can be evcited.

But you lose your bargaining power if you move out. so chances are just ask for ALL of security deposit back and go.

And if you dont get her to sign a release from all claims regarding your lease, then you still can be sued since you still have a vaild signed lease out there.

You didnt have to move, but YOU chose to, so you are not entitled to anything, since you have NOTHING in writing. I would expect to be paid 2/3 up front before i would even look in the paper for a new home.
