Initially purchased home in 1993 with mom. Refinanced in 2004 and we signed and notarized a quitclaim deed as well as a real property transfer report. In 2005, during the process of securing a home equity loan, underwriter disclosed that mom’s name is still listed on title. I have a signed and notarized copy of the quitclaim deed and transfer report. It’s also posted on the ACRIS website at nyc.gov.

Questions: (1) Was there an oversight on someone’s part?
(2) Does this mean the document was never filed and recorded?
(3) Should I contact the people who handled my 2004 refinancing? The city registrar?
(4) I’ve just closed on my home equity loan and my mom had to sign off on some of the papers (i.e., her name is on the mortgage, but not the note.) If I attempt to resolve this, would the contract I just signed be voided? Am I just opening a can of worms?

Thanks for any insight/information/insight.

(2) Does this mean the document was never filed and recorded? That is very possible; have a local title company run a title report for you to find out for sure.

(3) Should I contact the people who handled my 2004 refinancing? Yes. Don't expect too much help. The city registrar? You can try; don't expect any help.

Yes; but you really need to straighten this out.

... and as I kick myself, I’m thinking it’s a mess of my own making. When my loan consultant told me about this I asked if it would create a problem. For purposes of our closing she said it would not, however, it would hold up the closing. Should have exercised more patience and took care of it right then. At least I’ve got an email address to start with, but I’m not doing anything until that damn check is deposited and clears!
