I am attempting to enforce a foreign judgment, in pro se. The debtor is using every trick to delay what should be a summary proceeding (almost a year now!). We had a hearing, I gave the debtor the requested (and irrelevant) information, and we eached briefed it again. Now she (the debtor) has set another hearing date -- 6 weeks away!
How can I ask the Court to rule immediately on the briefs? I'm sure this must be possible in this kind of summary proceeding (in fact, the judge DID enter my judgment in the beginning, but the debtor managed to have it stayed pending more "discovery") but I don't know how. Also, this is the Circuit Court, so the judge may not even be in town at the moment.
"Motion for immediate ruling on the briefs"? I have the impression that the judge normally won't even get the case file until right before a scheduled hearing, but I have to fight back against the debtor who is using every possible trick to delay things.
The court clerk hasn't been very helpful. The hearings are a HUGE hassle for me (which the debtor knows); but I'm in trouble if I don't show up, right? Will a TN Circuit Court allow a phone hearing?
This routine proceeding has been briefed to death and I am completely willing to let the judge make his ruling.
Any real-life court experience with this kind of situation would be very helpful, even if your facts (or state) aren't exactly the same.
