I live in Georgia. In August, 2000, I rented out my house and I moved in with my friend, the relationship came to an end. I want to move back in my house, but I do have a lease with the tenant.
The tenant has really been one big headache, she said that there's squirrels in the attic and I put this electronic device in there and secure the area in which the squirrels were coming in. The device was then moved and she called me back and said she still hear the squirrels in the attic, she want to call an exterminator man (whom she know) and told me that she will deduct it from the rent. I don't believe that squirrels are in the attic, I walked the whole entire attic and there's no way for them to get in. I did put the electronic device back in the attic and told her I will contact her in 3 days. But she don't rake or keep the yards clean on the property and this is since August 2000.

I really need some advice, I have documented everything and given her a copy, whenever she calls and whenever work is done at the house. Also, she want to know is the electronic device going to run up her light bill.

sorry buddy a lease is a lease, and you can only evict her if she doesnt pay the rent, not because shes an asssshole!

You want the place back ..well write her a letter stating you would like the place back, and are willing to give her 30 days free rent (FEB) her full security back, and a couple of hundred for moving expenses say ($200), if she vacates by Feb 28th....

she will probably take it.

And i the letter say that the tenant acknowledges this is also a 30 day notice to vacate,

BUT you must also inculde a strong warning, that failure to COMPLETELY vacate and remove ALL items from the premisis, by feb.28, voids this agreement, On March 1st you will have to evict her in court and will demand Feb rent be paid plus any damages and legal fees.

remember she signed the agreement acknowledging a 30 day notice to vacate, so on march 1st she is a holdover, and you can start eviction proceedings.

Also give her a bank certified check when you get the keys and have her sign another letter stating that she has recieved the money. always make at least 2 copies and sign BOTH.
