Our deed to our primary residence is in my
husbands name and our now deceased mother can we just get the deceaseds name removed from
the deed without getting a lawyer involved?

No, unless the deed specified that they were joint tenants with right of survivorship. If they were JTROS, visit the recorder's office and ask what they need to see before you can file a new deed in his name or your names. (Probably a death certificate.)

If they weren't JTROS, then mom's estate has to be probated before the executor can transfer the house to husband. See an estate attorney for help, or read about it in your local library's self-help legal books section.
