I own a condo and had 2 roommates. everything okay until about 3 weeks ago. roommate #2 started acting wierd / nutsy. His cat which I said was okay to keep (without extra deposit) if he properly cared for the pet; peed / sprayed his room and it currently reeks of urine. His wierd behavior has driven roommate #1 to giving me 30 day notice. Last week; roommate #2 said he was leaving at the end of the month (one weeks' notice). then changed his mind and gave me 30 day notice to leave at the end of february. I may or may not get the rent. .......Can I simply kick his pitiful butt out of the house ! or do I have to go with the legal 3 day notice etc. court forum.
we have to written rental agreement. And he won't get rid of the cat. Help...Majimon...I am in santa barbara county, california.

You gotta go thru the legal procedures or YOU could be liable for the TENANTS damages.

You can give him a notice to cure say 10 days to get rid of the cat, and i say this with some tears in my eyes cause i love cats,and have NEVER had any of them spay,peed,pooped anywhere except a litter box, so i never lost a pet deposit, which of course you should always get.

Or else you will start evcition proceedings, because he has violated the lease.

thanks. djdj. I thought that might be the answer. The Law definitely can override common sense. as in this case. No rent: get out. Won't get a litter box for the cat: get out. Instead. You've given tenant home, shelter, comfortable living in exchange for an agreed upon monetary consideration. Now I (landlord) must be at the mercy of this jekyl and hyde tenant because the Law loves and protects this type of monster.

OH ARE YOU SO WRONG....... the law doenst protect this monster of a tenant

No majimom the law protcets us against dictators like YOU who refuse to abide by the rule of law in this the greatest country on earth.

YOU are the problem, you want to be KING QUEEN JUDGE and jury....just like a good Communist!

So abide by our laws and you will be a lot happier and smarter the next time you take on tenants.
