What is the name of your state (only U.S. law)? SD....I HAVE A MAN~WHOME I'M STILL MARRIED TO} that will not leave my home, that I'm renting and all bills are in my name, I have asked him several timesto leave and he will not. Can I throw him out and change locks? I am seeking help for a divorce pro bono if I can....I have asked some places and they say I have to be seperated from him for 30 days...what ex does that mean...he has slept on couch for 3 mo.now and will not go...what do I do?

Why don't you move? It's his place too.

You can't throw your husband out and change the locks. Illegal. I know, you think you can because your name is on the lease/bills. You can't. You are married. Your situation is no different than the reverse (stay at home wife, has nothing in her name, husband cannot just toss her out and change the locks).

If you don't know this and want a divorce "pro bono" then you don't know the bare minimum about divorce law and really can't afford to not hire an attorney.

You need to obtain an attorney. If you cannot afford one, contact legal aid and they can perhaps recommend some reduced rate attorneys that may be willing to work with you.

Presuming that he is employed, you would then request that your attorney file a pendente lite support motion to compel STBX to contribute towards roof expenses.

Good luck. Please feel free to come back with more questions as you progress in your divorce.
