What is the name of your state? NC but Will was in AK

This is perhaps an odd situation ... I was seriously involved with a man several years back and became close to his dad, who adored my daughter. When the relationship ended his dad and I remained close. My friend was not in the best of health so he spent winters here in NC and summers in Alaska. Three years ago my friend passed away from his 3rd major heart attack while he was in Alaska.

He bought several Savings Bonds for my daughter and not long before he died he wrote me a letter saying that he had made arrangements for her in his Will. After he died his youngest son, who was the executor, allowed us to remove my daughter's bedroom suite from the house, and the 2 bonds that had been in her jewelry box were gone. When I asked him about it he said that he didn't know anything about the bonds or her being in the Will.

I didn't like it, but didn't know how to fight it, really. I tried for more than a year to make contact with him to see if the bonds turned up as he cleaned out the house. He never responded to email or phone calls.

A few months ago I sent a request to the treasury dept asking them to research her savings bonds. They found eight. This leads me to believe that my friend's son did lie to me. I'm trying to get them reissued, even though, I'm supposed to get the executor's signature, though I can't seem to contact him. Today, I sent him a return receipt requested letter regarding the Treasury Dept forms.

How do I go about finding out for myself about the will? I know where my friend's home address in Alaska was, but I have no clue who the attorney was.

And just to head off the suspicion at the pass ... I'm not trying to get the money for myself. We want to put it in her 529 college fund.

If there is no record of the will being filed, you need to consult an attorney in the same county in Alaska where the death occurred to see if you can get probate opened up specifically for the purpose of getting the will produced from whoever has it or having probate go forward without the will. Son may be deliberately withholding the will from being probated in order to prevent other beneficiaries from getting anything.

Also, you need to ask the Treasury Department specifically how the bonds are titled (are they in both the decedent's name and your daughter's name as joint owners?) because how they are titled makes a big difference in what can be done to get them cashed in.

Suzz,
What happened to the "man you were serious with"? Does he have any input in this matter? How is his relationship with "the youngest brother"? How much money are you talking about here?

Well ... he and I have not spoken since the funeral, and then it was only basic pleasentries. As far as I know he still lives in the same town, but, he didn't have anything to do with the will, having gotten the money his father had set aside for him several years before. Plus, he was never happy that his dad and I stayed close, he saw it as his father being disloyal to him.
The letter mentioning the Will to me said $5000. Maybe not enough for some people to go psycho about, but it would pay her first year of school.
