Question, My husband and his ex have a 12 year old son, who resides with his mother in Virginia. She wants him to come live with us in Florida. They have never had a custody issue, they have always been mutual and kept it civil and have never needed to go through the courts. Problem is I want some sort of formal paper stating that we have custody of him and he is going to be living in different state, mainly because I will be the one to get him enrolled in school and such, and my husband wants to make sure that I have the right to make decisions for him in case of emergency. His son's mother said to find out what she needs to do to give us custody and let her know. She basically, sadly, does not want to be in her sons life as of right now and called my husband and asked him if we could take him. Any suggestions what we would need to file or what to do?
