hi, i'm trying to find out how i go about suing someone (small claims) that is out of state?

I made an online transaction a while back, never recieved the item, and by the time i reported it to Ebay/PayPal "my time to file a chargeback" had expired (30 days) . So i got a subonea served to PayPal to get the information and find out who took my money (total of $1031). And as it turns out, this guy lives in Philadelphia. Now i have to cancel my court date, because from what i understand small claims law suits only works locally.

anyone know how to pursue a case out-of-state without having to fly to philadelphia and filing in their small claims department? (i'm fulltime student)

If you are talking about filing a claim with Paypal, yes it is 30 days, but you said you filed a chargeback. If you used your credit card and not your Paypal balance then you can still most likely file a chargeback through your credit card.

Far as suing goes you have to go to his state.

You can always go to the community chat forum on Ebay and ask someone for the link that will bring you to a website that tells you exactly what you need to do to file a small claims.

I am in the process of suing a woman in PA over an ebay dispute as well. Unfortunately, you will have to file in the county where the seller lives. My seller lives in Lancaster so I had to file with a district magistrate in that county. You will need to do some research online to find out the process for your seller's specific county. The process differs quite a bit from area to area. In my case, I am out close to $7k so a plane ticket is worth it to get back my money. You can always include all of the court fees in your lawsuit. Another important consideration is if your seller actually has assets to get paid if you win a judgement. Good luck!

ebay/paypal filing claims

Actually the time alloted to file a claim is not 30 days but in fact is 45 days. You also may not file a dispute or claim on intangable items sent electronically. if you purchase something on ebay and or thru paypal and it cannot be pysically shipped you cannot file a claim and are not covered on the protection plan.
