What is the name of your state? New Jersey

I moved to the US eleven years ago from Brazil. When I arrived, I was legal under my father's work visa. Three years ago, when I turned 18 the visa expired. I have been living in the US illegally ever since. I need to know, if I was to return to Brazil, where my parents now live, would it be possible for me to return to the US legally and attain a new visa of my own? Or, will the authorities do a background check of my legal status and punish me for "over-staying" the amount of time allowed on my visa when I return/ depart the US? I also need to know the proper steps needed to attain legal status in the United States.
