My younger brother who is 8 years old got into a fight at School, the other kid started it but lost the fight. (He has black eye & a busted lip) his parents are mad at him & want to press charges. My brother is only 8 (turning 9 in three days), can they still charge him??

This is in Texas btw

Children under the age of 10 cannot be prosecuted for crimes in Texas, but the Department of Family and Protective Services can become involved with children under 10 who are in need of services.

The school may have considerable range in what to do ...and if it has a zero tolerance policy about fighting ...might suspend both fighters for a short time ...
