I have a friend whos wife up and walked out on him and 6 kids. They promised each other that niether one would file for divorce since the didn't want to burden each other with child support.
Yeah right we all know how this one is going to turn out!
My question is if she turns around and files for custody and support how likely is she to get what she wants since she abandoned her kids. 3 of the kids are his only by adoption but still his legally.
Mom has a history of mentally instability. She is 25 and her step mom is her leagal guardian. Would that hold in court?

Tell him to go see an attorney first thing Monday morning and file for custody.

If he is trying to raise the children alone now, he doesn't need to to have her come back in their lives a year or two down the road and file.

He can file for custody without filing for divorce.
