What is the name of your state? West Virginia
My husband's father passed away in January of 2006. While he was taking care of the arrangements with his sister at the cemetary, he let her fill out the paperwork stating that she was the purchaser of the mausoleum and she guaranteed payment within thirty days. Before the end of the month, my husband paid for the funeral and the crypt in full. Should the cemetary send the deed to my husband since he is the one who paid for the crypt?

Yes, there is room for two. He was going to turn the deed over to his ex-step-mother since she had taken care of his father and she wished to be buried beside of him. The only problem now is the funeral home and cemetary sent the deed to his sister and put her as the owner and she refuses to turn over the deed. My husband feels he is the rightful owner since he paid for the crypt.

Yes, he contacted the cemetary and they are stating they received the money from his sister. We have the receipts to show that my husband made the payment himself.

then I would take my receipts down there and demand a refund, if they say that they also received the money from the sister. See what they have to say then;)

He can't even rest in peace. Did the father have an estate? If so, your husband can file a claim with the estate for the purchase price.

Thanks for the info. My husband talked to the administrator of the estate last night, and we are going to send copies of the receipts to her. She is going to the funeral home and demand they fix the deed or refund the money. If not, we will file a claim against the estate.
