husband eligible for alimony?

I have a full time job, 40 hours per week. My husband has not worked in over a year. He has no disability etc that would stop him from working. It was an agreement that we had. He would look after our child and I would work. He is going to file for divorce and he told me that he is eligible for 50% of my wages as I support him now.

1. If we divorce, is he eligible for 50% of my wages?
2. He wants full custody. If he gets it, what % would he be entitled to?
3. Would he have any chance of winning custody based on the fact he does not work? I pay all expenses, I have full medical coverage for my child and I have full day care facilities I pay for.

From what he is telling me if he gets full custody of our child, I will owe 50% of my wages and this will be enough for him to live on without working. Is this just a threat or is this the way the law really works.

Probably not. But the final decision is up to the court.

2. He wants full custody. If he gets it, what % would he be entitled to?

Child support per your state guidelines.
Alimony per the discretion of the court.

YES.

He's the wrong gender to be throwing statements like that around.

Consult with an attorney in your area.

If he thinks he's going to sit on his dead @ss, not work and just collect money from you, he's in fantasy land.

Why not? if your agreement with him was that he stayed home while you worked why wouldn't he be entitled to spousal support? Does it matter that it's a guy getting the support as opposed to a woman? How long have you been married? What was his occupation before he stopped working?

...then why is he staying home to "look after the child"? You pay for daycare and the kid doesn't go?
