My 1st husband and I were married in Florida in 1995, in 1997 he moved out of our home and was subsequently arrested for a DUI charge. During his "stay" in the county jail he contacted me and asked for a divorce, which I was all too happy to agree to. I met him and he produced papers for me to sign and told me he would have his attorney file them immediatly as there was no property to dispute nor any children, he claimed a hearing was not necessary. I belived this and married husband #2 a year later. We were doing geneology research for our grandson and I requested a copy of the divorce from the Bureau of Vital Statistics in Fl and was stunned when they sent back a letter stating there is no divorce on record! I have no idea where this guy is or what state he lives in and now I'm not sure what to do to unravel all this mess. Do I need to divorce my current husband, then file a divorce from husband #1 and then remarry. Or since marriage #2 is not legal is it necessary to file at all? Please help!!!!

Ok, now what you do is get yourself an attorney ASAP. You are a bigamist (like it or not). The fact of still being married to your first husband does not invalidate your second marriage though! Go get a divorce and quickly, an attorney will know how to file the appropriate papers even if your 1st hub can not be found. Expect to pay at least $1500.
