I live in Texas. I have been seperated from my husband for almost three years. Shortly after we separated, he confessed to me he had been living a secret criminal double life. He is in prison now for some of the things he did. I am wondering if I have to split our marital assetts with him, since he was so deceptive. We were married in December of 1989. I am filing a Default Divorce against him in the next few days. Are judges sympathetic to spouses who have been victimized and deceived by criminals?

My response:

Apparently, your decision to separate was not based upon his "criminal" background - - you said that you found this out afterwards. You may have been "victimized", but it had nothing to do with his "double life" because you never knew about it while you were with him.

Therefore, I don't see how these facts would make any difference whatsoever regarding marital assets, unless there's more to this story.
