husband not citizen - property?

What is the name of your state (only U.S. law)? ny
My husband is a green card holder and says he does n't want to be a US citizen b/c he will have to give up his British citizenship. He earns a good living - we own our home, but it is in his name (my credit at the time would not have helped us) we own it outright. We do not have a will. God forbid if something were to happen to him, because he is not a US citizen, what will happen to his/our estate? (401 (K0, property, etc) Is this not an immigration question maybe? (I know we ned to make a will - he is 56 yrs old)....not to mention the fact that I know he really should becomTe a citizen he will have more protection from the law..THanks

If you're a legal resident you have the same rights as a citizen in terms of protection under the law (and a non-citizen can't vote - for all intents and purposes that's the only difference) .

Should anything happen the estate will be dealt with the same way whether he's a green-card holder or citizen.

If that is his only objection, then the matter is solved. He does NOT give up his British citizenship if he naturalizes to US citizenship. My spouse is dual UK/US and the rest of my family is also dual.

Estate taxes are not equal for US citizens and PRs. PRs get a considerably shorter end of the stick. Some Social Security benefits will not pay out if the PR is living outside the US, but will pay for US citizens abroad.

It's also the only way to guarantee remaining in the US. Personally, I think it's the only responsible thing to do if you have a family here.
I notice in another post from you that you have a child; he may also be a dual citizen. You should look into that to expand his future opportunities.
