I gave my husband a digital camera for Christmas. Before we decided to split he said there was no need for it anymore and I should just sell it and get my money back.I told him I didnt want to sell it and that I would just keep it.He agreed. So I began to make plans with the camera as for I assume I would stay with it.Now from one day to another he needs it and decides now he will keep it.I told him to just buy another digital camera later on since I am in need of it now and he doesnt need a camera till later. Is this one of those issues that will be fought in court? It was a gift at the beginning but he literally gave it back to me.I havent moved out yet so were in the process of splitting the property.I'm in CA

My response:

Attorneys, like myself, really love potential cases like yours. Why ? Because we make oodles of money on fights like yours. That $300.00 digital camera all of a sudden winds up costing $5,000.00 ! We see this type of thing all the time, whether it's cameras, coffee tables, televisions, etc., and the list is endless. Sure, I'd fight for your rights to the camera - - but, is paying me worth the trouble ?

In other words, give him the camera, by yourself another, and save big money in the long run.

But, then again, I tell people this all the time, and they don't want to listen. I'll see you in my office on Wednesday. Bring your checkbook.

I wished it was a $300 digital camera but its actually worth $5000..its a Canon D30 with an expensive lense...so its worth its value..I guess reason why I want to fight for it

My response:

Well, that's your business. But, keep in mind, the value of the item is directly geometric to the amount of attorney's fees you'll be paying - - just to make your point and win.
