Husbands jail time and custody

What is the name of your state?Kentucky
My husband stayed 9 months of a 3 year sentence for trafficing a controlled substance. Since then I have been working to make ends meet and providing for our 4 year old. He is on now parole. We have been seperated for about 2 weeks now. I'm concerned about his custody rights. Can he get custody of my daughter? And what precautions can I take to prevent that from happining?

She is not "your" daughter, try "our" daughter. Both of you have equal rights to custody, visitation and support.

Under the circumstances, its fairly unlikely that he would get primary custody.
Felony drug convictions tend not to impress judges.
