hysterectomy gone wrong

Hello, in April 2014 my wife had a hysterectomy; everything went fine with the surgery. The day the staples were removed, that evening the incision busted open, this was late Friday evening. She called the surgeons office Saturday am and was told to pack it with a saline dressing and come to the office on Monday am. Come Sunday she now has a fever and the open incision is looking very green and slimy, called surgeon again, he called in antibiotics and said to come to the office in the am.
When arrived at the Dr. Office Monday am, they immediately sent her to hospital and even had a room ready for her upstairs upon arrival at hospital (they admitted her). She ended up staying a couple days with a couple procedures happening during her stay.

She started going to a wound care center where they are still to this day trying to get the wound to heal. She has since had two more surgeries on the same wound to try to heal it. The last surgery was to make the wound larger by cutting out the scar tissue that was already there, this is where we feel the original surgeon was wrong, the original surgeon cut exactly where three other prior surgeries were done, as a surgeon, he should have known that cutting into scar tissue, and it would never heal properly.

This created a very large wound the measured about 8 inches long, 4 inches wide and 4 inches deep. She has been on a wound vac, did hyperbaric chamber treatments and now requires daily wound changes by myself until home health care takes over this weekend. Wound care is saying as long as it heals properly this time, it may be around Christmass before it is all the way healed. We have taken pictures of the wound from day one, including when the staples were in and have continued on a almost daily basis.
We feel that the surgeon should have known better and should have cut in another area, and also should have told her to go directly to the hospital upon the wound busting open.

Should we pursue leagal action?

That sounds very stressful. I hope your wife recovers well this time.

Only your wife, and to a limited extant you, can decide on legal action. From what you posted, it seems like you guys should continue to work on getting her healthy before worrying about whether to sue or not. That said, it might not be a bad idea to talk to the doctor and find out what happened or visit with an experienced med-mal lawyer.

So the answer is: Yes, no, or maybe.
